The office works with employees to respond to proposed disciplinary actions and performance actions and, if necessary, appeal actions to the Merit System Protection Board.
The office represents federal employees relevant to employment discrimination claims under Title VII of the Civil Rights Act of 1964, as amended (discrimination based upon sexual harassment, gender, national origin, race, color, religion), the Rehabilitation Act of 1973 (discrimination based upon disability), Age Discrimination in Employment Act(discrimination based upon age), Genetic Information Nondiscrimination Act of 2008 (GINA) (discrimination based upon genetic information). These claims have a different process to follow compared to non-federal employees. Summary of the fededral sector process for discrimination claims may be found here. The time frame for a federal employee to initiate a discrimination complaint is very short - 45 days from the unlawful act.
The office handles complaints to the Office of Special Counsel. OSC’s primary mission is to safeguard the merit system by protecting federal employees and applicants from prohibited personnel practices, especially reprisal for whistleblowing.
